Automatic Termination of Automatic Stay

If a debtor in bankruptcy does not file his statement of intention or follow through on it within 30 days or as required by Section 521 (a) (2) the stay terminates with respect to the property because it is no longer property of the bankruptcy estate.

The Law Firm of Mitchell Howie has recently been litigating a case where the client had made her mortgage payments through her military retirement account, but the bank had started foreclosure because she did not have the proper account number on the checks. The bank swore they were not being paid. Only after Mitchell Howie obtained copies of the finally able to obtain the canceled checks did they quit attempting to collect and foreclose.
